These general conditions are written in French in their original version which alone is authentic and prevails over any other version translated into a foreign language.

These general conditions apply in their entirety, without restriction and without reservation, to all sales of products made online by the company MYTHIK MYSTIK on its website at https://www.mythikmystik.com to consumer buyers. of the whole world.

They constitute the essential and determining conditions and prevail over all general conditions and/or all other documents issued by consumer Buyers, whatever the terms.

Consequently, the fact for any Consumer Buyer to order a product offered for sale on the website https://www.mythikmystik.com implies full acceptance of these general conditions of sale, of which the Buyer acknowledges having read beforehand at his command.

MYTHIK MYSTIK reserves the right to modify these general conditions of sale at any time.

If one or more stipulations of these general conditions of sale are held to be invalid or declared as such pursuant to a law, a regulation or following a final decision of a competent jurisdiction, the other stipulations shall retain all their strength and scope.

The fact for one of the parties not to take advantage of a breach with the other party of any of the obligations referred to in these general conditions of sale cannot be interpreted for the future as a waiver to the obligation in question.

The online sales service is reserved for all Buyers who are adults and who purchase Products outside of any professional activity, for their strictly personal needs only.

Also, prior to any order, the Buyer declares that:

  • his purchases of Products on www.mythikmystik.com are unrelated to his professional activity and are limited to strictly personal use;
  • have full legal capacity, allowing it to engage under these general conditions of sale.

The Purchaser is personally responsible for setting up the IT and telecommunications resources allowing access to the Site www.mythikmystik.com.

The Purchaser shall bear the cost of telecommunications when accessing the Internet and using the said site.

In accordance with article L 111-1 of the Consumer Code, the Buyer may, prior to his order, take note, on the Site www.mythikmystik.com, of the essential characteristics of the Product(s) he wishes to order.

The offers presented on the site www.mythikmystik.com are valid within the limits of available stocks.

The photographs, graphics and descriptions of the Products offered for sale are only indicative and do not bind MYTHIK MYSTIK.

The Buyer having read the Products and their characteristics, chooses under his sole responsibility and according to his needs as he has previously determined them before any order, the Product(s) he orders.

Any order of Products is subscribed directly online on this Site using the form provided by MYTHIK MYSTIK.

As mentioned above, any order implies acceptance without restriction or reservation of these general conditions of sale.

Subject to the right of withdrawal referred to in the following article 7, any order will become final from the sending to the Buyer of an order confirmation email by MYTHIK MYSTIK and receipt by the latter of the full price. MYTHIK MYSTIK recommends that the Buyer keep this information in a paper or computer document.

MYTHIK MYSTIK will always reserve the right to cancel a sale, even after receipt of the confirmation e-mail, in the event of a lack of bank confirmation of the actual payment of the sum claimed.

Any “click” by the Buyer under the order form constitutes an electronic signature which has, between the Parties, the same value as a handwritten signature.

All sums paid to the order by the Buyer do not in any way constitute a deposit, the abandonment of which would authorize the latter to withdraw from the contract.

The benefit of a contract is personal to the Buyer and cannot be transferred without the agreement of MYTHIK MYSTIK.

MYTHIK MYSTIK reserves the right to refuse any order from a Buyer with whom there is a dispute relating to the payment of a previous order.

In accordance with article L121-20 of the Consumer Code, the Buyer has a period of 15 (fifteen) clear days from the date of receipt, to return the Products ordered at his own expense, for reimbursement.

The Products must imperatively be returned to MYTHIK MYSTIK in perfect condition for resale, in their original condition (packaging, accessories, instructions, etc.), duly sealed, and accompanied by the invoice corresponding to the purchase.

Similarly, if the Product includes a warranty sheet or any other document to be completed, this must not be completed so that the Buyer can exercise his right of withdrawal.

Any incomplete Product, showing traces of use, damaged, damaged or whose original packaging has been damaged, will not be refunded or exchanged.

The exercise of the right of withdrawal will give rise to the Buyer’s choice:

  • or a refund in cash, by recrediting the bank card entered during the initial order.

If the voucher does not bear any mention to the contrary, during its period of validity, the Buyer may request, by simple call to customer service or by e-mail, to convert this voucher into a refund.

This refund will take place in priority by crediting the credit card entered during the initial order.

In the event of partial use of the voucher, the remainder will remain available to the Buyer under the same conditions as the original credit note.

A purchase voucher will be considered used in the event of even partial use or a request for reimbursement.

By the very fact of using this voucher, the consumer agrees on his honor not to raise any dispute or opposition with his bank or other, to the transaction concerned by the refund, and undertakes not to do so within a period of one year following the use of the purchase voucher

The consumer acknowledges being aware that any breach of this obligation would expose him to the retrocession of the sum unduly received, without prejudice to the damages that could be claimed from him by MYTHIK MYSTIK.

In case of unavailability of the Products ordered, MYTHIK MYSTIK will inform the Buyer as soon as possible.

In accordance with the provisions of article L121.20.3 of the Consumer Code, MYTHIK MYSTIK may in this case provide a Product of equivalent quality and price. All shipping and return costs resulting from the exercise of the right of withdrawal referred to in the previous article 7, will then be borne by MYTHIK MYSTIK.

If MYTHIK MYSTIK fails to make use of this option, the Buyer will be reimbursed without delay and at the latest within thirty days of payment of the sums he has paid.

The sale prices of the Products online on the website www.mythikmystik.com, indicated in Euros, are those in force at the time of registration of the order form by the Buyer. Prices include value added tax (V.A.T.) applicable on the day of the order.

They do not include shipping costs, invoiced in addition to the price of the Products purchased according to the amount of the order. The shipping costs will be indicated before the registration of the order by the Buyer.

The selling prices of the Products may be modified by www.mythikmystik.com at any time. This change will be notified to the Buyer before any order.

The Products are payable in euros when ordering.

The collection of the entire amount of the order will be made by MYTHIK MYSTIK at the time of validation of the order.

To pay for his order, the Buyer has all the means of payment referred to in the order form: bank card (credit card, Mastercard, Visa, American Express), bank transfer.

The Buyer guarantees to MYTHIK MYSTIK that he has the necessary authorizations to use the method of payment he has chosen, when registering the order form.

All electronic payment by credit card is secured via Paypal. The bank details entered are encrypted using the SSL (Secure Socket Layer) protocol and protected using a security system intended to prevent unauthorized third parties from intercepting this data, accessing it, deforming it or diverting it to their profits. MYTHIK MYSTIK will not keep any bank details.

By communicating his bank details, the Buyer accepts in advance and without conditions that MYTHIK MYSTIK proceeds with the secure transaction. The Buyer therefore authorizes his bank in advance to debit his account in view of the records or statements transmitted by MYTHIK MYSTIK, even in the absence of invoices signed by the hand of the cardholder.

MYTHIK MYSTIK reserves the right to suspend or cancel any order and/or delivery, whatever their nature and level of execution, in the event of non-payment of any sum due by the Buyer, or in the event payment incident.

The delivery of any new order may be suspended in the event of late payment of a previous order, notwithstanding the provisions hereof.

As part of the fight against Internet fraud, information relating to your order may be transmitted to any third party for verification.

11.1 – General rules

The Products will be delivered to the address indicated by the Buyer on the order form.

In the event of partial availability of the Products, MYTHIK MYSTIK may have to split the orders. Thus, the available Products can be sent initially, the balance of the order will be sent when all the other Products ordered are available.

MYTHIK MYSTIK offers Buyers to be delivered by post in letter followed, or by carrier Failure to comply with the procedures set out below, no claim from the Buyer will be accepted.

11.2 – Post office standard delivery characteristics

The Buyer is delivered to his home by a delivery man from La Poste.   • to apply the procedure of the Post Office (in particular to report the damage due, all complaints and reservations) and to refuse the goods by immediately issuing a report of anomaly to the Post Office;
  • to report these incidents to MYTHIK MYSTIK.

11.3 – Deadlines

The average times from the www.mythikmystik.com depot for delivery in Metropolitan France are as follows: 2 to 7 working days.

These deadlines are provided for information only.

Any overrun may not give rise to damages, withholding or cancellation of the order by the Buyer.

The Buyer may not protest against any delay in execution and/or delivery in the event that he is not up to date with his obligations towards MYTHIK MYSTIK, in particular in terms of payment, or if MYTHIK MYSTIK had not been in timely possession of the information necessary for the execution of the corresponding deliveries.

However, and in accordance with the provisions of article L 121.20.3 of the Code of

Consumption, the Products ordered will be delivered within a maximum period of thirty days from the day following that on which the Buyer registered his order, subject to full payment of the price.

In the absence of delivery at the end of this period, the Buyer will have the possibility of canceling his order.

The sums paid by the Buyer will then be returned to him without delay, to the exclusion of any other compensation.

In the event of a delay in delivery in relation to the date initially fixed, the Buyer must report it in writing (mail, fax or via the contact form) in order to improve the quality of service which may be offered to him and to allow MYTHIK MYSTIK to conduct an investigation with the carrier.

An investigation with the carrier can take up to 21 working days. If during this period, the Product is found, it will be immediately redirected to the place of delivery designated in the order form.

On the other hand, if the ordered Product is not found at the end of this period of 21 days of investigation, MYTHIK MYSTIK will proceed at its expense to a new shipment of the Product ordered by the Buyer.

In the event that the Product ordered is then no longer available, the provisions referred to in Article 8 will be applied. In the event of a subsequent exchange of Products, the delivery costs will be borne by the Buyer.

The products are sold subject to retention of title until full payment. In this respect, the payment means the effective payment on the account of MYTHIK MYSTIK of the products, the costs relating to the sale and the interests.

In the event of non-payment, even partial, of a due date, the Buyer must, at his own expense and risk, return the unpaid Products which, if applicable, have been previously delivered to him, after request serving as formal notice by registered letter with acknowledgment reception.

Notwithstanding the retention of title clause stipulated in the previous article 12, the Products ordered from MYTHIK MYSTIK will be in the custody of the Buyer from the date of their delivery as defined in the previous article 11. Also, from the said delivery, the Buyer alone will bear the risks that the Products may suffer or cause, for any reason whatsoever, even in the event of force majeure, fortuitous event or due to a third party.

14.1. The conformity of the Products (condition, absence of defect, number, etc.) must imperatively be checked by the Buyer upon receipt of the Products, in the presence of the carrier if necessary; the costs and risks relating to the verification of the Products being borne by the Buyer.

14.2. By the effect of this reception, MYTHIK MYSTIK will be released from all apparent defects.

In the event of delivery of a Product that does not correspond to the order (defective or non-compliant), the Buyer must formulate his complaint within 7 days of signing the distribution slip.

14.3. Complaints must be sent by registered letter with acknowledgment of receipt to the address indicated in paragraph 2 hereof, and must include:

  • the Buyer’s contact details;
  • Product references;
  • the grounds for the complaint.

However, as mentioned above in the previous article 11.2, in the event of delivery by post, the Buyer will be required to apply the post office’s procedure (in particular to report the damage due, all complaints and reservations) and to refuse the goods by immediately issuing a report of anomaly to the Post Office.

15.1. The Products offered by MYTHIK MYSTIK comply with the French legislation in force.

15.2. The Buyer will benefit from the legal guarantee against hidden defects (article 1641 to 1648 of the Civil Code), the legal guarantee of conformity (article L 211-4 and following of the Consumer Code).

15.3. Certain Products sold benefit from a manufacturer’s warranty, the terms and conditions of which vary from one supplier to another. The general conditions and the duration of the guarantee are available on the website www.mythikmystik.com. The Buyer will be deemed to have consulted and accepted them.

In the event that the notice is not delivered with the Product, and at the consumer’s request, MYTHIK MYSTIK will send the notice in French or a link allowing access to it.

15.4. In any event, these warranties are limited to the repair of Products recognized as defective or to their exchange or reimbursement at the convenience of MYTHIK MYSTIK, as well as to the payment of postage and shipping costs. of the said Products, excluding any payment of damages.

15.5. Furthermore, the warranties do not cover:

  • visible defects, i.e. defects in visible appearance not declared by the Buyer when delivering the Products;
  • normal wear and tear of the Products;
  • consumable replacements.
  • abnormal and non-compliant use of the Products.
  • damage specifically mentioned in the item sheets;
  • defects and their consequences due to the intervention of the Buyer or a repairer not approved by MYTHIK MYSTIK;
  • defects and their consequences related to use that does not comply with the use for which the Products are intended (professional, collective use, etc.);
  • Products covered by a specific assistance and maintenance contract.

16.1. Apart from the application of the right of withdrawal referred to in the previous article 7, any return of the Product under the guarantees referred to in the previous article 15, must be subject to the prior agreement of MYTHIK MYSTIK. To this end, the Buyer will contact the after-sales service of MYTHIK MYSTIK. Also, no return will be accepted without prior authorization from MYTHIK MYSTIK.

If the returned Product is recognized as defective, MYTHIK MYSTIK will send the Buyer a Product return number. This return number, a determining and essential condition, is valid for seven working days, from the communication of the return number by MYTHIK MYSTIK to the Buyer. After this period, the Purchaser must renew his request, according to the procedure described above.

16.2. In any case, any Product return must be returned in its original packaging, include all of the Product and its accessories and be legibly accompanied by the Product return number communicated by MYTHIK MYSTIK.

Any Product that is incomplete, damaged, damaged and/or whose original packaging has been damaged, will not be taken back or exchanged under the guarantee.

16.3. The shipping costs are the responsibility of MYTHIK MYSTIK, except in the case where the returned or exchanged Product does not correspond to the original declaration made by the Buyer in the return form. Any risk related to the return of the Product is the responsibility of the Buyer.

16.4. Failure to comply with the procedure set out above and the deadlines indicated, the Buyer may not make any claim for non-compliance or apparent defect of the Products delivered, the Products then being deemed to be compliant and free from any apparent defect.

Subject to specific provisions provided for in point 7 above, any reimbursement payable by MYTHIK MYSTIK will be made in the form of a voucher to be redeemed on our site.

In all cases, MYTHIK MYSTIK will communicate when allocating this voucher by e-mail:

  • its period of validity.
  • whether or not the Buyer will be able to request a refund.
  • its amount.

If the voucher does not bear any mention to the contrary, during its period of validity, the Buyer may request, by simple call to customer service or by e-mail, to convert this voucher into a refund.

The orders are executed in current quality with the tolerances of the French and European standards, without any responsibility of the company MYTHIK MYSTIK as to the use for which the Buyers intend them and as to their conformity with the texts of the legislation and standards in force in their country. Also, it will be up to the Buyer to check with the local authorities the possibilities of importing or using the products or services he plans to order.

MYTHIK MYSTIK cannot be held responsible for non-execution of orders in the event of out of stock or unavailability of Products, force majeure, disruption or total or partial strike, in particular of postal services and means of transport and/or communications.

MYTHIK MYSTIK cannot be held liable for any consequential damages that may arise from the purchase of the Products.

MYTHIK MYSTIK can not be responsible for any loss of data, files. It is the Buyer’s responsibility to make all the necessary backups.

The total or partial inability to use the Products cannot engage the responsibility of MYTHIK MYSTIK nor give rise to any compensation or reimbursement.

The www.mythikmystik.com site also contains information from third parties, and links to other websites. MYTHIK MYSTIK can in no way be held liable for damages resulting from the use of access to, or the inability to use, this third-party information, nor the content of other websites.

Sales of MYTHIK MYSTIK Products are subject to French law. In the event of a dispute, the French courts will have sole jurisdiction.

The information collected by MYTHIK MYSTIK during any order from the Buyer is necessary for the management of his order by MYTHIK MYSTIK and its business partners.

In accordance with the Data Protection Act of January 6, 1978, it is recalled that each

Buyer has a right of access, opposition, rectification, modification and deletion of any personal data concerning him.

Are considered as cases of force majeure with regard to the obligations of MYTHIK MYSTIK, events beyond its control and which it cannot reasonably be expected to foresee.

This will also be the case in all circumstances, even if they do not fall within the aforementioned definition, in particular cases of popular movements, acts of terrorism, machine breakdown, fire, storm, water damage, strike, shortage of raw materials, legislative or regulatory provisions, blockages of means of transport and supply of telecommunications networks, blockages of computer networks (including the switched networks of telecommunications operators), failures of the public network distribution of electricity, loss of Internet connectivity, likely to prevent or hinder the execution of the present.

The Purchaser will not have any intellectual and industrial property rights over the Products, as well as over any documents associated with them, MYTHIK MYSTIK remaining the exclusive owner of all these rights.
